Terms of Service
Last updated: October 15, 2026
These Terms of Service are an agreement between you and Brooklyn Uprising LLC, operating Topo (“Topo,” “we,” “us” or “our”), for your use of Topo websites, mobile apps and member software (“Services”). Please read them before accepting them or using an account. If you act for another person, you must have authority to do so.
What Topo provides
Topo provides software for connecting with participating gyms, managing accounts and memberships, checking in, making purchases and bookings, completing forms and waivers, and receiving communications. Available features depend on the gym and service you use.
These terms cover Topo's software. The gym identified in your account or purchase provides the relevant gym services and sets its membership, pricing, cancellation, refund and participation terms, subject to applicable law. Those terms and any signed waiver apply separately. Brooklyn Uprising LLC also operates Brooklyn Uprising gym; when it is the seller, the gym purchase remains governed by the applicable gym agreement.
Our contracts with gym businesses separately govern their purchase and administration of Topo. These public terms do not replace those contracts.
Eligibility and authority
You must be at least 13 to create or sign in to your own Topo account. If you are under the age of majority where you live, you must have the permission of a parent or authorized guardian, and that adult must accept these terms on your behalf where required by law. Additional requirements may apply in your jurisdiction.
Parents and authorized guardians can use their own accounts to manage gym participation and records for children under 13. A guardian-managed record does not authorize the child to sign in independently.
You must provide accurate information and maintain any information needed for your account. You may manage a dependent, household or payment arrangement only when authorized. Being a payer does not automatically confer all guardian rights, and sharing an email address does not establish authority over someone else's account.
Accounts and security
Keep your sign-in codes, links and devices secure. Do not share credentials or use another person's account or admission pass without authorization. Tell us promptly if you believe your account has been accessed without permission. You are responsible for activity you authorize, subject to applicable law; these terms do not make you automatically liable for every unauthorized transaction.
The app can remember and sign in to separate accounts at multiple gyms. An action at one gym does not automatically apply to another. Signing out or removing an app does not cancel a membership or delete gym records.
We may require reasonable verification before changing account access or acting on a request involving another person.
Purchases and gym services
Review the seller, price, taxes, billing frequency, renewal details, minimum commitment, access limitations and cancellation/refund rules before completing a purchase. Recurring charges require the authorization presented for that purchase. The payment provider may impose additional terms for its services.
Contact the gym about its facilities, services, purchases, membership changes and refunds. Contact Topo about software problems. Where a problem concerns both, we may coordinate with the gym.
Nothing in these terms changes mandatory consumer rights or authorizes charges beyond your purchase agreement. Topo's service terms do not create a universal no-refund rule or rewrite an existing gym contract.
License and acceptable use
Subject to these terms, we allow you to use the Services for their intended purposes. This permission is limited, nonexclusive and nontransferable except as applicable law or the relevant app-store license permits. We and our licensors retain ownership of the software and associated intellectual property.
You must not:
- Access accounts, records or systems without authorization.
- Impersonate another person, misrepresent guardian authority or misuse admission credentials.
- Interfere with security, availability or other users' access.
- Upload malicious code or use the Services for fraud or unlawful activity.
- Harass others or submit content that unlawfully violates another person's rights.
- Copy, distribute or reverse engineer the software except as permitted by these terms or applicable law.
Information and content you provide
You retain your rights in content you submit. You grant us and the providers helping us deliver the Services permission to host, process, transmit and display that content as needed to provide the features you request, carry out authorized gym instructions and satisfy applicable obligations. Our use of personal information is also governed by the Privacy Policy and applicable law.
This permission does not give us an unrestricted right to sell your personal information or use your image in unrelated advertising. You must have the rights and authority needed to submit information or content about another person.
We may restrict unlawful or abusive content and respond to credible reports of misuse. Public community, video or social features may have additional terms and visibility controls when offered. These terms do not themselves make private gym records public.
Community content
Some gyms let members share climbing content with other members, such as beta videos, First Ascent names and climber profiles. There is no tolerance for objectionable content or abusive users. You must not post content that is sexual, hateful, violent, harassing, bullying, defamatory or unlawful, that shows someone who did not agree to be filmed, or that is spam or advertising, and you must not use these features to abuse other members.
Before you first post, you accept your gym's community guidelines, which are part of these terms. Your gym's staff and Topo may review, hide or remove any content and suspend or end posting access or an account that breaks these rules, without notice.
- Report anything that breaks these rules from its menu. It is hidden for you at once and goes to your gym's staff for review. You can also email help@topoclimb.com.
- Block a member from their content or profile. Neither of you then sees the other's community content. They are not told. You can unblock them from your account's privacy settings.
Communications and privacy
We and your gym may send communications necessary to provide accounts, security, transactions and requested services. Optional marketing is subject to the choices offered and applicable law. You can manage available preferences and device notification permissions. Turning off push notifications does not change your membership or payment obligations.
The Topo Privacy Policy explains our information practices. Your gym's notice explains its practices. Accepting these terms is not blanket consent to optional marketing, advertising tracking or every use of sensitive information.
Third-party services
Payment, device-platform, Wallet and other integrated services may be supplied by third parties under their own terms. We remain responsible for obligations that apply to us; identifying a third-party provider does not waive your legal rights.
The applicable app-store license also governs your downloaded application. For iOS apps without a custom license, Apple’s standard end-user license applies. These terms govern the Topo Services and do not displace mandatory app-store license provisions.
Changes, availability and safety
We may maintain, update or change the Services. We will provide notice of material changes where required. We do not guarantee uninterrupted or error-free access, but we will address service problems consistent with our obligations.
If a pass, booking or account record appears incorrect, contact the gym or Topo before relying on it. The Services are not emergency services and do not provide medical advice or a guarantee that climbing or another physical activity is safe. Follow the gym's instructions and rules. These software terms are not a liability waiver for physical participation.
Suspension and termination
We may restrict access when reasonably necessary to address a security threat, fraud, unlawful activity or a material violation of these terms. Where appropriate and legally permitted, we will explain the restriction and provide a way to resolve it. We may need to act immediately to protect the service or other people.
Ending software access does not by itself determine your rights or obligations under a separate gym agreement. Mandatory refund, access and consumer rights remain in effect.
You may stop using the Services at any time. To cancel a membership, use the gym's cancellation process. To request deletion of a gym account, use the available account controls or contact help@topoclimb.com. Review the effects on linked memberships, bookings and payments before confirming. Removing the app is not a cancellation or deletion request.
Account deletion and retained records
You can request deletion at help@topoclimb.com or through the relevant gym’s available account controls. Account closure and erasure of information are distinct; the Privacy Policy explains archived records and how requests for erasure are assessed. Limited records may remain where needed for applicable legal, insurance, tax, accounting or other specifically justified obligations, including information necessary to identify a participant and connect them to their waiver, attendance and transactions.
Deleting one gym account does not delete another gym's account. A request involving dependents or shared payment responsibilities may require verification and resolution of those relationships. We will explain necessary steps rather than treat a request as permission to disrupt another person's account.
Deletion does not automatically erase a valid debt or produce a refund, and it does not waive rights you have under applicable law. An authorized later restoration of access does not automatically restore removed information, restart canceled billing or renew marketing consent.
Warranties and responsibility
To the extent permitted by applicable law, we provide the Services on an “as available” basis and disclaim implied warranties of merchantability, fitness for a particular purpose and noninfringement. This does not exclude warranties or remedies that the law requires us to provide.
We are responsible for our own obligations. A gym is responsible for its gym operations and promises, subject to applicable law. Neither this allocation nor any disclaimer excludes liability that cannot legally be excluded, including applicable liability for fraud, willful misconduct or personal injury.
Resolving concerns
Contact help@topoclimb.com with a description of the concern so we can try to resolve it. You remain free to exercise applicable statutory rights or contact a regulator.
Changes to these terms
We will identify the effective date of updated terms and provide notice appropriate to the change and applicable law. Where renewed agreement is required, we will obtain it. Changes do not retroactively rewrite completed gym purchases or remove accrued legal rights.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Our failure to enforce a provision immediately does not waive it. Any transfer of our agreement must preserve protections required by law.
